Welcome to Ninav, accessible at ninav.in and through the Ninav mobile application (collectively referred to as the “Platform”). These Terms and Conditions (“Terms”) govern your access to and use of the Ninav platform and services.
By accessing or using Ninav, creating an account, or continuing to use the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.
Throughout these Terms, the words “Ninav”, “we”, “our”, or “us” refer to the Ninav platform and its operators, and the words “user”, “you”, or “your” refer to any person who accesses or uses Ninav.
These Terms apply to both the Ninav website and mobile application and must be read together with the Ninav Privacy Policy.
Nature of the Service
Ninav is a social communication platform designed to enable users to connect and interact with one another through messaging, voice communication, and other social features provided within the Platform. The purpose of Ninav is to provide a safe and respectful environment where users can engage in meaningful and positive communication.
Ninav operates solely as a technology platform that facilitates communication between users. Ninav does not create conversations, monitor every interaction, or guarantee the identity or intentions of any user. All interactions on Ninav are voluntary and initiated at the discretion of users.
While Ninav aims to maintain a safe environment, users acknowledge that interactions with other users are undertaken at their own discretion and risk. Ninav shall not be responsible for the conduct or behavior of any user on or off the Platform.
Eligibility
Use of Ninav is limited to individuals who are legally capable of entering into a binding agreement under applicable law. By using Ninav, you represent and warrant that you are at least eighteen (18) years of age and are legally permitted to use the Platform under the laws of India or any other applicable jurisdiction.
Ninav does not permit the use of the Platform by individuals under the age of eighteen. If we become aware that a user is under eighteen years of age, the account may be terminated without notice.
Account Registration and Security
In order to access certain features of Ninav, users may be required to create an account by providing certain information such as a mobile number or profile details. Users agree to provide accurate and complete information during registration and to keep such information updated.
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users must not share their login details, verification codes, or account access with any other person.
If a user becomes aware of any unauthorized use of their account, they must notify Ninav immediately. Ninav shall not be responsible for losses resulting from unauthorized use of accounts.
Each account is intended for use by a single individual only. Creating multiple accounts for misuse or impersonation is prohibited.
Ninav does not permit the use of the Platform by individuals under the age of eighteen. If we become aware that a user is under eighteen years of age, the account may be terminated without notice.
User Conduct and Acceptable Use
Ninav is intended to be used in a responsible and respectful manner. By using the Platform, users agree to behave in a civil and courteous manner toward other users at all times. The Platform is designed to promote positive communication, and users must ensure that their conduct reflects this purpose.
Users must not engage in harassment, intimidation, bullying, threats, or abusive behavior toward other users. Repeated offensive behavior or communication intended to disturb or harm other users is strictly prohibited and may result in suspension or permanent removal from the Platform.
Ninav strictly prohibits hateful or discriminatory communication. Users must not post or transmit content that promotes hatred or hostility against any individual or group based on religion, caste, ethnicity, nationality, gender, sexual orientation, disability, or any other protected characteristic. Content that encourages violence or discrimination is not permitted under any circumstances.
Ninav is not intended to be used as a dating or adult communication platform. Sexual content and sexually explicit communication are strictly prohibited. Users must not engage in sexual conversations, request sexual content, share explicit material, or make sexually suggestive remarks. Any attempt to use Ninav for sexual purposes may result in immediate termination of the account.
Users are expected to use Ninav in good faith and for constructive purposes. Activities such as fraud, scams, impersonation, spamming, or misleading other users are strictly prohibited. Users must not attempt to deceive other users or misuse the Platform for personal gain through dishonest means.
Users must comply with all applicable laws while using Ninav. The Platform must not be used for illegal activities, including but not limited to fraud, unlawful trade, or criminal conduct. Ninav reserves the right to cooperate with law enforcement authorities where required by law.
Content Responsibility
Users are solely responsible for any content they create, share, or transmit on Ninav, including messages, profile information, images, and other materials. By sharing content on Ninav, users confirm that they have the right to share such content and that it does not violate any laws or the rights of others.
Ninav reserves the right to remove any content that violates these Terms or that is considered harmful, offensive, or inappropriate, even if such content does not explicitly violate a specific rule.
Ninav does not guarantee that all inappropriate content will be detected or removed immediately.
Account Suspension and Termination
Ninav reserves the right to suspend, restrict, or permanently terminate user accounts at its sole discretion if a user violates these Terms or engages in behavior that may harm other users or the Platform.
Account suspension or termination may occur without prior notice where necessary to protect users or maintain the integrity of the Platform.
Termination of an account may result in the loss of access to all data associated with that account.
Ninav shall not be liable for any losses resulting from account suspension or termination.
Intellectual Property Rights
All intellectual property rights associated with Ninav, including the Platform design, software, branding, and content created by Ninav, are owned by Ninav.
Users are granted a limited, non-transferable license to use the Platform for personal use only. Users may not copy, distribute, modify, or reverse engineer any part of the Platform without permission.
Unauthorized use of Ninav intellectual property may result in legal action.
Privacy and Data Use
Ninav may collect and process certain information necessary for the operation and improvement of the Platform. Such information may include account details, usage information, and technical data.
By using Ninav, users consent to the collection and use of data as described in the Ninav Privacy Policy.
Ninav takes reasonable measures to protect user data but cannot guarantee absolute security.
Service Availability
Ninav aims to provide reliable service but does not guarantee uninterrupted access. The Platform may occasionally be unavailable due to maintenance, technical issues, or factors beyond our control.
Ninav reserves the right to modify or discontinue features at any time without notice.
Third-Party Services
Ninav may include integrations or services provided by third parties, such as hosting providers, analytics services, or payment processors. These third-party services operate independently and may be governed by their own terms and policies.
Ninav is not responsible for the actions or policies of third-party services.
Changes to the Terms
Ninav reserves the right to update these Terms at any time. Updated Terms will be published on ninav.in.
Continued use of Ninav after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising from the use of Ninav shall be subject to the jurisdiction of Indian courts.
Disclaimer of Warranties
Ninav is provided on an “as is” and “as available” basis. Ninav makes no guarantees regarding the accuracy, reliability, or availability of the Platform.
Users agree that use of Ninav is at their own risk.
Limitation of Liability
To the maximum extent permitted by law, Ninav shall not be liable for any direct or indirect losses arising from the use of the Platform. This includes losses resulting from user interactions, service interruptions, data loss, or unauthorized access.
Ninav shall not be responsible for the conduct of users or for any disputes between users.
